The present conditions of sale will be understood accepted by the users who have initiated the process of purchase, being them of application in the terms that correspond according to the phase of contracting in which they are.

 

Although in any case these General Conditions shall apply, BIOLUMINIS INTERNATIONAL CORPORATION, S.L., as the owner of the website and the only legitimate to define its conditions of use, reserves the right to withdraw, replace or change its content when it deems it appropriate, and without prior notice.

 

These Conditions of Sale apply to the sale of products by Bioluminis International Corporation S.L. Please read these conditions carefully before placing your order to Bioluminis International Corporation SL. By placing your order, you agree to be bound by these conditions.

2.What do we do?

This website is dedicated to the sale of the so-called “Filters and articles Bioluminis”. The detailed information of each article, as well as its price and characteristics, can be found by clicking on each product through the different sections in which they are classified.

However, the Web is entitled to stop offering, without notice and at any time, access to such products.

The products offered at any time will be governed by these general conditions.

 

3.What are our prices?

The price of our products, which does not include VAT, is indicated for each of them in the different sections of the Web. However, this tax would be excluded in case the shipment must be made to countries outside the European Union.

Shipping costs, however, are not included, so the amount will be shown before the end of the purchase process for you to expressly accept them.

 

DELIVERY AND TRANSPORT

Shipments are made by registered mail in the Spanish territory and by international transport company (SEUR, DHL, UPS, or other selected by the client) with the respective legal documents.

 

* CUSTOMS INFORMATION

If the country of destination of the order does not belong to the European Union, you may be obliged to pay import duties and taxes, different from the amount of the purchase, which will be charged at the time of delivery at destination (and which BIOLUMINIS will not be responsible for, but the customer).

 

BIOLUMINIS INTERNATIONAL CORPORATION has no control over this type of amounts related to customs clearance, which will always be the responsibility of the customer, so we recommend that before placing any order the appropriate consultation is made at the customs office. In addition, given that for the acquisition of these products you can have the condition of importer, you will have to take into account the fulfillment of all the obligations that the Law demands in the country where the product is going to be received.

 

4.Shipping costs

Shipping costs depend on the destination, and will be specified according to the characteristics of the order.

 

Their amount will always be shown before the end of the purchase process so that you can know and accept them expressly.

 

5.Methods of payment

 

The means of payment we accept are credit and debit card (VISA and MASTERCARD), as well as Paypal and advance transfer.

 

5.1. Conditions of Invoicing and Expedition.

 

Spain

– Company with CIF: Application of the IVA (21%) (CIF number of the client obligatory for the management of accounting)

– Self-employed: DNI number, Application of VAT (21%)

– Individuals: Amounts less than 400 € /simplified invoice VAT 21%.

Amounts greater than 400 € / required data and Customer ID IVA 21%.

Member States European Union

– Company with fiscal identification number, registered in the Intra-Community Operators Registry (ROI) : Exempt from Spanish VAT ( ROI ; obligatory fiscal identification number for accounting management).

– Self-employed and Individuals : National Identification Number .

– Expedition:

– Spain and European Union by registered mail or another mode of transport chosen by the client who bears the cost in full.

Export: rest of the world except European Union.

– Invoice gross amount, expedition by certified mail or transporter with Legal Documents of the country of departure and country of destiny. The buyer assumes the customs rules and payment of duties in the country of destination.

 

6.How and when will I receive my order?

 

The shipment will be made within 30 working days at the delivery address indicated, unless otherwise communicated (PLACE OF DELIVERY) on the order sheet of the website.

 

In order for this to be possible, it is necessary that we have been provided with the exact details for shipping (address, etc.), as well as a telephone number of mandatory contact for the delivery form of the carrier who notifies the customer of the date and time of delivery.

 

When you receive the order you must examine it before the carrier to verify that it has arrived in good condition. If not, you must note the observations of the defect on the sheet of the delivery note of the carrier also make a copy of the delivery note and send it via Email to bioluminis@bioluminis.com

 

In case the shipment could not be made effective because no one is at the destination address, we will contact you to try delivery at another time.

7.How can you purchase our products?

 

  1. Enter the online store of our website, where you will find the different categories of products. All you have to do is click on the one you are most interested in to get to the articles we offer in each category.
  2. To know the details of the product, click on the image. A new screen will appear explaining the specific characteristics of the article. These features are listed in greater detail in the gray tab, under the label “description”.

If you have found the product you want to buy, click on this screen on the blue button that says “add to cart” (you can buy more than one item by specifying the number just next to that button).

After that, the product will be included in the basket (top right), so you can continue shopping or finalize the purchase.

  1. If you want to finalize the purchase, click on the icon of the basket. A tab will open with the selected products and you will have to click on the “cart” button. The next screen will show a summary of the order and to continue with the purchase you will have to click on the button “finalize the purchase”.
  1. On the next screen you can enter a coupon discount if you have it. In addition, you can formalize the sale as a registered user (in which case you will have to use your user name and password), or register by filling out the form with the information we need to formalize the order.

If the address provided does not coincide with the delivery address, in this step you must indicate where you want the order to be sent.

In addition, you will see in a small box these General Conditions of Sale, which you must know and accept in order to continue with the purchase, as well as the Privacy Policy of the website.

AVAILABILITY OF THE PRODUCTS

 

8.Are the products you offer always available?

 

Yes, we only offer products that we have. However, you must bear in mind that, although BIOLUMINIS continually updates the stock, if it should happen that you request an out of stock product, you will receive an email informing you of the impossibility of the purchase and, if applicable, of the possibility of purchasing it later.

 

All this without prejudice to the possibility of resolving the sale, in which case we will return the amounts paid.

 

GUARANTEES AND AFTER-SALES SERVICE

 

9.What can I do if I receive the product in poor condition?

 

If on receiving your order you notice that the order is not complete or that it has suffered some damage, even if it is in the packaging, it is essential that you leave a written record on the delivery note when you sign it, and communicate it to BIOLUMINIS as soon as possible after receiving the product.

 

To do so, send us an email to BIOLUMINIS@BIOLUMINIS.COM, attaching one or more photographs of the order in the places where it is damaged, together with the following information:

 

– It clearly indicates in the subject of the email that it is a return for an order received with some damage.

– Your name and surname

– Full address (address, town, province, postcode)

– Telephone

– Email

– Codes of the items in your order that you wish to return.

If the claim is considered justified, we will change the item and send you a new one, in which case we will assume the transport costs (you would only have to pay for sending the return).

 

9.1. Warranties and after-sales services

 

BIOLUMINIS is obliged to deliver products that conform to the contract, responding to any lack of conformity that exists at the time of delivery of the product and those that are manifested during the following two years.

 

In the event of a defective product, BIOLUMINIS shall proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, which shall be free of charge for the purchaser, who shall only be responsible for the shipping costs of the product (without prejudice to the fact that they shall be paid in the case of a defective article). In case of non-conformity, you must notify us within two months of becoming aware of it.

 

We emphasize, however, that a lack of conformity shall not be deemed to result from improper use or application of the product, or from any manipulator not in accordance with its nature.

 

10.What can I do if I receive the product in poor condition?

 

Bioluminis International Corporation S.L guarantees the perfect state of the articles sent. Each order is reviewed, care in the shipping packaging according to your order.

 

If on receiving your order you notice that the order is not complete or has suffered some damage, it is essential that you leave a written record on the delivery note when signing it, and communicate it in writing with acknowledgement of receipt to the carrier, within 3 days after notification of receipt of the goods. Make a copy of this defect and send it via Email to: bioluminis@bioluminis.com 

 

We will need you to attach one or more photographs of the order at the locations where it is damaged, along with the following information:

– Indicate clearly in the subject of the email that it is an incident of transport for an order received with some damage and add copy of the delivery note with the respective observation as well as copy of the registered letter sent to the carrier.

– Full address (address, town, province, postcode)

– Telephone

– Email

– Codes of the items in your order that you wish to return.

If the claim is considered justified, we will send you an email with the instructions to process the change of the article.

 

11.Right of withdrawal

 

Withdrawal is only accepted for items kept in its blister sealed from origin, without in any case accepting the return of items removed from their original packaging, for reasons of hygiene (filters must be applied directly on the skin).

 

With this in mind, you can cancel the contract for a period of 14 calendar days from receipt of the good (whether you received it yourself, or an authorized third party – provided it is not the carrier).

 

In the event that the order includes several items and you have received them separately, the period will begin to run from the moment you have acquired material possession of the last of these goods.

 

In order to exercise this right, it is not necessary for you to justify your decision; it will suffice for you to inform us unequivocally within 14 days and then, within a further 14 days, to return the products -whose shipping costs would be borne by you-.

 

We will understand that you have exercised the right of withdrawal when you have sent the aforementioned communication within the period indicated, to the address BIOLUMINIS@BIOLUMINIS.COM, indicating in the subject your order number. You must inform us of:

– Your name and surname

– Your order number

– Full address (address, town, province, postcode)

– Telephone

– Email

– Codes of the items in your order that you wish to return.

– Optionally, you can tell us the reason for your return to help us improve the service.

Once the right of withdrawal has been exercised correctly, we will refund the corresponding amounts within 14 calendar days of the date on which you have informed us of your decision. However, in order to ensure this refund, we may withhold the refund until the return of the property becomes effective.

Having said this, and although you can exercise this right, we will provide you with the means we have indicated to you previously, and we will try to resolve any doubts you may have by means of these questions:

– What expenses do I have to pay if I return in acquired good?

Although we will never demand any penalty for the exercise of a right, you will have to assume a series of expenses resulting from the return:

– Costs of sending the return of goods

– Can I use the goods and then return them?

No. You are only allowed to test and inspect the items you have purchased as you would in a physical store. This is minimal handling.

 

12.Products of durable nature

 

The customer will benefit from the legal guarantee explained above. However, the warranty does not apply if there are faults or damages due to improper use, lack of maintenance and care contrary to our maintenance instructions.

 

The purchaser should refer to the appropriate instructions and recommendations contained in the instructions for use provided with each product.

 

13.Protection of personal data

 

Under the provisions of current legislation on the Protection of Personal Data, we inform you that the data you provide through the page will be the responsibility of BIOLUMINIS INTERNATIONAL CORPORATION, SL, in order to manage the sale of selected products and, where appropriate, send information, including by electronic means, on issues relating to the activity of the company and its services, being kept for as long as necessary to respond to queries raised and manage the service or product contracted.

 

Your consent and our relationship with customers legitimates the processing of your data, which will be kept for as long as necessary to meet the purposes indicated and meet our legal obligations.

 

You can exercise, at any time, the rights of access, rectification, suppression, opposition, limitation of the treatment and portability of the data by means of electronic mail addressed to BIOLUMINIS@BIOLUMINIS.COM attaching copy of the DNI. If you deem it appropriate, you may also contact the Spanish Data Protection Agency.

 

14.Applicable Legislation and Submission to Jurisdiction

 

The sale is understood to have taken place in Spanish territory, so that for any interpretative or litigious questions that may arise, Spanish legislation shall apply and, in the event of a dispute, both parties agree to submit to the jurisdiction of the Courts and Tribunals of Valencia, with the exception of consumer matters, in which case the applicable procedural rules shall apply.
